Distance Sales Agreement

1. Parties

2. Subject of Agreement
This agreement governs the rights and obligations of the parties regarding the sale and delivery of the digital subscription service purchased by the BUYER through MindBall web or mobile channels, in accordance with the Consumer Protection Law No. 6502 and the Distance Contracts Regulation. After activation, premium access may be used across supported platforms.
3. Service Features
Service Name: MindBall Premium Subscription Service Type: Digital content subscription service Scope: Personalized breathing sessions, weekly wellness plans, dream journal, emotion tracking and insights. Platform: Web, iOS, and Android. Premium access is available across supported platforms after activation. Language Support: Turkish and English
4. Service Fee and Payment
Subscription Plans (VAT included): • Monthly Plan: 650 TL/month • Annual Plan: 1,650 TL/year (~138 TL/month) All plans start with a 48-hour free trial. If not cancelled during the trial period, the subscription automatically starts and is charged. Payment Method: Collected through the original purchase channel selected by the BUYER, such as web or the relevant app store. Payment details are handled by the relevant billing channel.
5. Payment Security
All payments are processed through the original purchase channel used by the BUYER. Payment credentials are not stored on the SELLER's servers unless required by the relevant billing channel's secure flow.
6. Service Delivery
The digital subscription service is activated immediately upon payment confirmation. The BUYER gains access to premium features across supported MindBall platforms after completing the purchase and logging in with the same account. Due to the digital nature of the service, there is no physical delivery.
7. Right of Withdrawal
Pursuant to Article 53/ı of Law No. 6502 and Article 15/ğ of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for services performed instantly in electronic environment and intangible goods delivered instantly to the consumer. However, no charges are collected from BUYERS who cancel within the 48-hour free trial period. The BUYER may cancel their subscription at any time through the original purchase channel. App Store purchases are cancelled in Apple ID settings, Google Play purchases in Google Play account settings, and web purchases through the web billing/account support flow.
8. Cancellation and Refund
8.1 Subscription cancellation takes effect at the end of the current billing period. No partial refund is issued for unused time. 8.2 In case of duplicate payment due to a technical error, the excess amount is refunded within 10 business days. 8.3 If the service cannot be used at all due to technical failure, the BUYER may request a full refund by contacting support@themindball.com.
9. Dispute Resolution
The laws of the Republic of Turkey shall apply to disputes arising from this agreement. Consumer Arbitration Committees and Istanbul (Çağlayan) Consumer Courts are authorized.
